By accessing or using WeatherTrigger (the “Service”), you agree to the following Terms of Service (“Terms”). If you do not agree, you must not use the Service.

    1. WeatherTrigger provides software that allows advertisers to trigger advertising campaigns on platforms such as Meta and Google Ads based on weather conditions.
    2. You are solely responsible for configuring, monitoring, and managing your advertising campaigns and for verifying that any automation rules set within WeatherTrigger function as intended.
    3. You agree not to use WeatherTrigger for any unlawful, harmful, or misleading purpose.

  1. No Responsibility for Advertising Spend
    1. WeatherTrigger does not purchase or manage ads on your behalf. It only provides a tool to automate ad triggers based on conditions you set.
    2. You acknowledge and agree that all advertising costs, budgets, bids, and charges incurred through your advertising accounts (Meta, Google, or otherwise) are your sole responsibility.
    3. Plankton Digital Pty Ltd and WeatherTrigger shall not be liable for any advertising spend, over-spend, or unintended campaign results.

  1. Indemnification

You agree to indemnify, defend, and hold harmless Plankton Digital Pty Ltd, its directors, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising out of or relating to:
• Your use or misuse of the Service;
• Any advertising spend incurred through your accounts;
• Any error, misconfiguration, or omission in your automation setup;
• Any breach of these Terms.

  1. Service Availability
    1. WeatherTrigger is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted access, error-free performance, or that the Service will meet your requirements.
    2. Plankton Digital Pty Ltd may suspend, modify, or discontinue the Service at any time without liability.

  1. Limitation of Liability
    1. To the maximum extent permitted by law, Plankton Digital Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, or data, even if advised of the possibility of such damages.
    2. Our total liability to you for any claim arising out of or relating to the Service shall not exceed the amount paid by you to use the Service in the three (3) months preceding the claim.

    1. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
    2. You must promptly notify us of any unauthorized use of your account.

WeatherTrigger integrates with third-party platforms (such as Meta and Google Ads). Use of those platforms is subject to their own terms and policies. Plankton Digital Pty Ltd is not responsible for third-party services or their actions.

These Terms are governed by the laws of Victoria, Australia. Any disputes shall be subject to the exclusive jurisdiction of the courts of Victoria.
